These Terms govern your access to and use of the Services (described below) provided by Finpay Zone Finpay Zone, (we), (us), or (our). Before using the Services or gaining access to these Terms, please read them attentively. These Terms include our privacy policy, which can be found in (the "Privacy Policy"), and the Payment Partner's terms, which are defined below. By accessing and using the Services, you agree to be bound by these Terms, thereby establishing a contractual relationship with Finpay Zone. If you do not agree to these Terms, you are not permitted to access or use the Services.
You promise and guarantee that: (a) you are fully able to agree to and be bound by these Terms and Conditions; (b) you are at least 18 years old; (c) you live in India; and (d) you have all the registrations, licenses, rights, and permissions you need to agree to these Terms and Conditions. If you are acting on behalf of a company, organization, or other legal entity, you promise that you have the authority to bind that company, organization, or legal entity to these Terms.
To use the Services, you must create an account on the Platform with a username and password tied to your phone number and email address ("Account").
You agree to take reasonable steps to restrict access to (a) any device linked to the phone number or email address associated with your Platform Account and (b) any device linked to the phone number or email address associated with your Platform Account.
You are also responsible for maintaining your username and password, which you received when you created an account. Immediately notify us of any disclosure, unauthorized use, or other security violation involving your Account.
If we believe that you have violated any of the Terms, we reserve the right to disable any passwords or other codes that you use to access the Platform or to identify your actions on the Platform. To prevent unauthorized access to your Account, you must log out at the conclusion of each session.
You expressly consent and agree to be liable and responsible for all transactions that occur through your Record. Unauthorized access, such as hacking and security vulnerabilities, may result in any unauthorized transaction, refund request, or dispute made through your Account. We accept no responsibility for any of these actions.
You agree to receive communications from us regarding
(a) Finpay Zone and the Payment Partner have collaborated to make payments through the Platform more convenient. The Payment Partner Terms will regulate the payment processing in addition to these Terms. Finpay Zone is not liable for the actions or inactions of the Payment Partner.
(b) You consent to the Payment Partner settling all Transaction Amounts with you according to the Payment Partner Terms.
(c) If you or the customer have any queries, concerns, or complaints about the provided Payment Aggregation Services, please contact info@finpayzone.com.
(a) Depending on the type of subscription plan you buy, you may not be able to use all of the benefits of the Services. Each Service or subscription plan has its own set of benefits, abilities, and fees. You also agree that we have the right to enable or disable certain features on your account.
(b) You give us permission to charge you for the following subscription term(s) if the payment method you chose for your subscription plan supports auto-renewal. In this case, the fees for the contract will be paid regularly. If you choose "auto-renew" as your payment method, keep in mind that your access to the Services will be automatically renewed for as long as you choose.
(a) Services, material, documents, and information that belong to, are licensed to, or are otherwise made available by a third party ("Third-Party Services") may be included in the Services, as may links to these services. You agree that using Third-Party Services is entirely at your own risk and that the third party who made them or gave them to you is responsible for them.
(b) We don't make any promises, and we're not responsible for anything that comes out of or is related to these Outsider Services, including how accurate they are or how they turn out. If you use a Third-Party Service, you will be bound by the terms and conditions and privacy policies of the third parties that offer the Third-Party Services. Also, all intellectual property rights for Third-Party Services belong to the third parties that offer them.
Our Privacy Policy governs all of the information we collect in order to provide you with our Services.
You grant us permission to store and share backups with the Payment Partner when necessary for the Payment Partner to offer Payment Aggregation Services and with any Authority. This includes all information related to the Merchant Dashboard, your Account, your use of the Finpay Zone Services, and all electronic conversations with Customers, including those pertinent to their complaints.
To further enhance the efficiency of the Platform and the efficacy of the Services, we may use information and data about how you use them for analytics, trend identification, and statistical purposes.
Based on your permission, the Platform monitors, organizes, and analyzes your Orders and Platform usage to provide you with various ancillary services. If you give us permission, we may share Order and Transaction information with our affiliates. If we use your Order or Transaction information to identify and acquire appropriate ancillary services for you, we may charge you a facilitation fee. Moreover, you consent to this.
You represent and warrant that all information you give on the Platform or in connection with the Services is accurate, complete, and current as of the date you agree to these Terms and that it will be accurate, complete, and current while you use the Services. We disclaim all responsibility or liability for any loss or damage you may experience if you supply erroneous, incomplete, inaccurate, or misleading information or data in order to utilize the Services or if you fail to disclose any material fact.
You undertake not to criticize us or any of our affiliates in any way that could harm our goodwill, reputation, or commercial relationships with the general public, as well as any of our customers, suppliers, or employees, during or after the Term.
We either own or have a license for all rights, titles, and interests in and to the Platform and Services, as well as all intellectual property rights that come from the Platform and Services. We give you a limited, non-exclusive, non-sublicensable, royalty-free license to use the Platform as long as you follow these Terms and any written instructions we send you from time to time.
We may ask you to tell us what you think about the Services from time to time, such as by telling us about bugs or security holes ("Feedback"). We can use, copy, share, print, show, distribute, and make money off of the feedback you give us without asking for your permission, paying you a royalty, giving you credit, or putting any other restrictions on us based on your intellectual property rights.
Unless it says otherwise, nothing in these Terms should be taken as a license or right to any of our or a third party's intellectual property.
You shouldn't use any of the content on our Foundation for business unless we or our partners give you permission to do so. If you print, copy, or download information without following these rules, you will lose the right to use our Platform right away, and you will have to return or destroy any copies you have made.
You agree to protect Finpay Zone, its parent company, affiliates, officers, associates, successors, assigns, licensors, employees, directors, agents, and representatives from any direct or indirect losses, actions, damages, penalties, cost and expenses, claim, demand, lawsuit, or judicial proceeding (including, but not limited to, all damages, liabilities, settlements, costs, and attorneys' fees) related to:
Notwithstanding any other provisions, it is hereby stated that neither Finpay Zone nor any of its affiliates or related parties shall bear any responsibility towards you or any third party for any indirect, incidental, special, or consequential damages, loss of revenue, or profits arising from these Terms, including any actions taken by Authority or Payment Partners. The user consents to exempt Finpay Zone, along with its affiliated entities, subsidiaries, parent company, and all of their directors, officers, employees, and agents, from any and all legal claims, losses, damages, liabilities, expenses, and causes of action arising from their utilization of the Platform or the Services, in accordance with the maximum extent permissible by law.
We reserve the right to modify these Terms and Conditions and the Platform at any time. Merchants are required to examine these Terms and the Additional Terms each time they access the Platform or use the Services. Your use of the Platform and Services will be governed by the Additional Terms and these Terms, as amended from time to time. If you do not concur with these changes, you should discontinue using the Platform and/or the Services at that time.
We reserve the right, for business and operational reasons, to limit access to our Platform in whole or in part. Our Platform will not be accessible or uninterrupted at all times, and neither will we. We will do our best to notify you in writing of any such suspension or withdrawal as soon as practicable.
Even if a court or other authority rules that one of these Terms is illegal or can't be enforced, the other terms will still be in effect. If a part of a rule that is illegal or can't be enforced would be legal or could be enforced if it were taken out, that part will be taken out, but the rest of the rule will still be in effect.
You agree that we are not responsible if we break these terms because of something that was unexpected and out of our control. This could be, depending on the situation, a failure of any communication system, a breach or virus in our system, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, unauthorized access to computer data, and so on. In this case, we will be given a reasonable amount of extra time to do our jobs, and we will use all reasonable means to let you know about the Force Majeure Event and try to make it less bad.
Any dispute about these Terms must be taken to a court in India, and the laws of India must be used to figure out how to understand and follow them.
